245(i) is a political football right now. It will probably not get extended this year due to the fight between Bush and Fox over capital punishment. However, it is almost certain to come back in some form or another, for the following reason. The current law does not work, and the population of undocumented continues to increase. Once our economy picks up steam, even more undocumented will come to work, and there is no legal way for most of these people to be employed. Congress has two choices: either do a mass legalization, or pretend there is no problem and solve a small part of the problem through the back door. Congress will almost certainly prefer the latter to the former, and 245(i) is a perfect way to do the latter.
