I'd recommend speaking with a competent immigration attorney. With the last I94 you received coming in from Mexico you say you had a bit of a hard time re-entering. What information was exchanged at the port of entry as to the reason for your visit and what did you state was your marital status, if asked?

a "competent" attorney?? An immigration attorney??? On planet Earth??
There are more than 8000 members of AILA, and I doubt more than 2 have any real clue or ethics. The rest are only interested in billable hours, nothing more.
Anyone with an IQ above 85 can fill out any of the forms necessary for any kind of immigration benefit; however, if you are illegal, well, just leave and save money.
98% of immigration attorneys never go to court and never do much more than a) fill out basic forms on a laser printer [usually this is done by a paralegal] and b) write exaggerated cover letters when seeking H or L visas for people that have no experience or education.
For this, you want to pay $200 an hour [or more]??? Why?
These charlatans are nothing more than thinly disguised TV evangelists; they promise something they cannot deliver (green cards, front row in heaven) while fleecing the flock, either through billable hours or by asking for "love gifts" --- there is really no difference between these two "professions."
Hopefully you will stay away from these ripoff artists and do what needs to be done yourself.
