    Hi,
    If someone becomes USC based on marriage to USC (3 years) and they leave out information about a child they have had DURING the marriage in the N400, and later USCIS later learns this (say when the USC now wants to petition for kids to come to the US), can the citizenship be revoked on the basis that the kids were not mentioned when the N400 approval was given?

    Also, do you know the grounds USC status can be revoked?

        Citizenship can be revoked for marriage fraud; very few other reasons

            Naturalization can be revoked for a variety of reasons listed in INA § 340. The most common reason for revoking citizenship is a determination that citizenship was obtained illegally by fraud, willful misrepresentation, or concealment of a material fact. The DOJ files claim in Federal District Court and has to prove by clear, unequivocal and convincing evidence that the naturalization was obtained illegally.

            Did you lie on your naturalization form? Yes, the form requires you to list your children. Were you ineligible for naturalization? Perhaps, adultery during the statutory period is grounds for denial for lack of good moral character. Was this fraud, willful misrepresentation, or concealment of a material fact. Perhaps, you did withhold information that may have influenced the adjudication of your case. Will you loose your citizenship? Unlikely, most District Attorneys have better things to do. Unless you can be linked to terrorists, drug dealers, or Nazis, DOJ will likely not pursue this. However, by not listing the child on you applications, the child may have difficulties obtaining future immigration benefits.

                    But if you later marry the mother of the child left out on the N400, it wont matter whether it was your kid or not because a step child is also in the first category.

                    In any case, theres no way anyone can be sure that a child born is theirs when they dont live with the child's mother, which may explain why they were left out on the N400.
