    Raj Kumar arrived in this Country on a Immigration visa in August of 2001, upon arrival Immigration at Airport stamped his passport with A # at the same time his Attorney file I-130 for his son a student. Surash,(son) arrived on F-1 visa on Jan. 1999. He was inspected at POE by INS officer, I-94 allowed for 3 years. After one year he was allowed to work. has SSN, which says can work with INS Permission only. Paid Texas, left school in 2003 since then his F-1 Expired as well. In 2002 Attorney met with the accident and passed away Wife handed over complete files to all applicants within two months and closed the office.
    Raj wrote to USICS with news paper clipping,informing since he had no attorney and all paper work should be mailed to his address, About his son's immigration he attached copy of I-797C to forward all his sons paper work to his home address.
    Raj is now US Citizen, his son's I-130 is pending and his son is out of status.
    What should he do now?

      I think he had miss the boat.
      Because Raj arrived in US on August 2001, and the last date was April 30, 2001.
      If he would have file for his son by April 30, 2001 then he might have a chance to adjust his son's status.
      Why don't you recheck his documents and see when his father arrived here, and when he file for his son. He might have a chance to adjust his status.
