I am an immigration practitioner, not licensed till now, wanted you to through some light on this situation. I have a person who was issued an H-1B last November, but never came to US. I am sure that transfer is not possible in his case, but was thinking if there would be any problems filing his H-1B. I believe he is out of the cap. Any experiences you would like to share.
