I751 Waiver

Thx guys for your interest. Maybe I should clearify. Unfortunately, my joint petition took almst two years and by the time that was adjudicated, I got divorced. I did receive an interview letter but I withdrew my joint petition and filed a waiver. I received extention in Dec. 2004 for the waiver petition. June 2005, I received a letter saying my file has been transferred to the local office pending an interview. That was the last time I heard from UScis. From the time of my waiver petition todate is two years and I am wondering if this is normal. Has anyone experienced such delayance?

No no, I was asking if the jointly filed petition to remove the conditions,wasn't approved before the actual divorce?

Because by the time he (they) had their interview,was he by then divroced or just seperated.Because if he was only seperated,he should have not any problems...unless they mentioned it and what not.
But it looks like the application took 2 years and the notice came when they got divorced.

A jointly filed petition cannot be adjudicated if the parties have since divorced.

the fact that u were seperated does not make a difference actually,because either way u are still married by law.A divorce make a difference,as far application goes and all...

I got married in 1999.
Got conditional in Dec. 2000
Filed to remove conditions in Oct. 2002
Just before decision, I was separated in 2003
My wife offered to accompany me to interview if called, but I said no.
I field for devorce in 2004
Withdrew Joint petition and file waiver for good faith marriage.
Received extension Dec. 2004
I have heard from Immigration todate, but I have my passport stamped for status.

Is my experience normal, and has nayone experience this?

Sure this topic seems to come up here every month.My advice is,go through other I751 Waiver aka conditional removal,and you'll get all your info.

But let me ask you this,you were married from 99-2004, so if my math is right,thats bein married for 5 years? why would u have to file for ANY waiver???? makes no sence,u should have been settled already after 2 years of marriage.Weird...and then U got divorce in 2004?
but sent you waiver just now in december of 2006???

Though, I have gone to stamp my passport but no updated news. The delay has been two years now. Any one has any experience, is this normal that a waiver takes that long?
Caveat: I married 1999, devorce november 2004.
