    I'm waiting for a name-check before I

    Sammy said this recently:

    Is the president guaranteed to sign this, and when is it expected that he will?

    The situation for me is that I am held up on a name-check, but it is not 120 days after my interview yet. So I presume I can't sue yet.

    If the president signs this bill, will people who are stuck in a name-check be helpless?

    From what I understand, it won't be anylonger up to the Court to decide and grant Citizenship on grounds of delayed processing, rather Court would send it back to INS, and then it would be up to INS to decide the case whenever the "name check" is completed.
    So, at least in theory, under new law if your name check gets stuck for 20 years that is how long you would have to wait for the decision on your N-400 application.

    However, it is also reported (not related to the legislation you mention) that by year 2007 there will be the system in place to do name checks effectively and quickly, thus preventing future delays in all kinds of Immigration cases.

      I hope that you do sue the INS, I hope that you lose, and I hope that it costs you a lot of money. As a taxpayer, I hope that you also pay the INS's legal costs in defending themselves against your whining ****

      By the way, you're so smart that you don't even know that the INS no longer exists.

          In case anyone is wondering, this option to speed up the process via lawsuit is only available for N-400 (naturalization) applicants. Its not applicable for AOS applicant.

              Just asking questions here sweetie. No-one said I was going to sue anyone. I am glad you use this kind of site to vent your frustration and anger. As long as someone like you stays away from serial-killing, its all good!!

                One more thing SunDevilUSA (hope your neck isn't getting too sunburnt, if you know what I mean) this suing business is a tactic for people to make sure they are processed in time. You really should not take it personally. Most of these cases are settled out of court.

                    I've to disagree SunDevil. The OP is using an available venue for him. No different than those using AC21 to switch job/employers or those who choose DCF instead the K visas route. If something is available for your benefit, why not use it?
                    I think USCIS realize that and trying to cover for themselves with the new bill.

                        I heard about lot of people filed law suits against USCIS and got benefited by getting their approval much faster than other who are in the same pipe line for FBI name check for I-485 as well. USCIS use to keep this as their best resort to avoid issuing GC. [Similar to retrogression where it is been back dated to stone age]

                        There are many detailed articles and information in 'www.immigration.com' forums.
