Hi, my consulate is telling me that I cannot file an I-601 if I am applying for a K-3, they are saying that I have to wait for the I-130 to be approved first and then I can file the I-601. As for my I-130 application, the USCIS is saying that it will take 990 days for approval, that is 3 years form now. Is it true that I can't file the I-601 with a K-3, can somebody give me the the seccion of the INA where it says that I can file the I-601?

From what I know you file for K-3. If you're denied then you file I-601, not together. Anyone else know?

Thanks for the reply. The consulate is saying that, even if the K-3 is denied, which we know it will be, I cannot file the I-601 until my I-130 is approved!!! I am just so freaked out!!! We have been separated for over a year now, I cannot deal with three more years of this torture.

No. You only need the initial notice of receipt/action from BCIS stating that they have received your I-130 application - not the actual approval. Apply for a K3 along with a copy of the BCIS letter showing that they have received the I-130 application - and you are good to go. Don't submit a I-601 waiver app until they tell you that you need to. Which consulate are you dealing with?

I am dealing with the consulate in Santiago Chile. Innitialy they told us that we could file after the K-3 interview, now they are saying that we have to wait for the APPROVAL of the I-130.
Please help me with more information!!!!! My husband and I are freaking out!
