big dummy: by that I just meant that I didn't know of a divorce/ separation when I was sent home on vacation at which time my X-US Citizen spouse had already taken my "Conditional" GC. Yes, I traveled without a GC & returned in 5 months without one.. Too bad, for my EX who only has my CONDITIONAL GC - I fought back to get a PERMANENT GC.
Thanx, PASHA u've been an active member here.. I've in the mean time also got a promotion as ASST. MANAGER at work.. both in the same month!

I am in a similar situation, Pasha, Deepbobs please help.
Got my conditional approved earlier this year. Married with very clean intentions. Things became horrible and I think it will result in saperation -> divorce.
What do I need to do while applying to get conditional status removed. Is it ok to have been divorced or going thru a saperation period. What if the saperation process is not ongoing and I dont get both signatures on the form.
Please tell me all the precautionary steps I need to take. I would greatly appreciate any help.
Thanks.

Rememeber u still have the 2 years (minus 3 months) from the date of your permanent residence to file for removal of conditions.. So, in the mean time JUST COLLECT ANYTHING & EVERYTHING U HAVE IN YOUR POWER & REACH TO PROVE YOUR MARRIAGE WAS REAL.. And FYI DO NOT TRUST THESE WITHIN YOUR SPOUSE'S REACH..IF POSSIBLE OPEN A SAFE DEPOSIT BOX IN YOUR NAME & LEAVE THEM IN IT..INCLUDING U'R NEW GREEN CARD, SSC & PASSPORT.

any suggestions on which STATE or City is friendly - ?
I have lease, bills, life insurance, receipts of gifts, joint account statement, and joint Roth IRA account, joint tax filing, for up to one year. I dont know if she still wants to live with me, and she wont be on the next lease.
When its time to file the I-751, is it best if we have already been divorced or saperated or doesnt matter? I feel blessed that I came across this discussion - Go Google !

better stay together as long as u can.. what if the marriage turns out to work & u could live happily ever after.. Worse comes to worst, u could get separated & file on good faith after the divorce.. But, if not file a hardship waiver if separation takes longer than the deadline to file your waiver..city.state doesn't matter..Service Centre is where u file it..depending on which STATE U reside at the time of filing.

Finally, after all the struggle I have got my 10 yr GC by postal mail.. on the 25th..Hurray.. too bad, my ex is now left with an expired 2 yr card taken from me before aending me on a short trip (to file a divorce), so I wouldn't return to contest it...I feel so proud of myself now even though I have been thru the worst of my life..fighting a marriage, which to me the most precious thing in life..(but which turned out to my surprise to be the turning point of my life realizing it to be filled with adultery & unfaithfulness). I have learned the biggest lesson of my life, never to trust anyone so blind even if its your own spouse!!! Good luck to all of you out there who are honest abt their intentions..
