    My name is Gina my brother died June 2006. He died leaving a one year old boy. We were born and raised in Missouri. The problem is that my nephews mom is and illegal alien from Colombia. Her visa ran out in Dec. 2004. She was scared and had no money to renew her visa. She was also pregnant with my nephew. She has since moved back to New York with and aunt in hopes of getting citizenship. The judge has told her she doesn't stand much of a chance since she broke the law. This is absurd. I agree she broke the law but do my nephew and us as a family have any rights for her. Can we sponsor her and help her obtain citizenship. Myself and my family are good law abiding citizens who have worked hard all our lives and just want the only part of my brother left to be able to stay in this country. Not to mention if she does get deported and they take the baby with her as we know they will do. He will not be safe in Colombia. He is getting a substancial amount of money from my brothers life ins and social security. The guerillas target those with money there and his life would be in danger. I am desparate for any help or info anyone can give me. I can't bring my brother back but I also don't want to loose my nephew either.

      Hola Gina:
      This seems to be a very serious issue. So please do not waste time and get a legal advice from an immigration lawyer. If he says there is no way then think about adoption of your nephew. This way atleast your nephew will be safe and your sister-in-law would have better chance to fight for her case.

          No they were not married. And she would never let us adopt him. We tried to get temp guardianship and she thought we were taking her rights away. She doesn't understand we were only doing it for legal purposes.

            The only way is for her to married a USC, get her a boyfriend. She does need a new man in her life to take care of her and her son. Please don`t take me wrong on my advice. Just trying to solve your issue. it`s the easiest way! Hope everything turns out ok.
