  • need help!!

    i am a green card holder in the States for 2 yrs now and I will get marry with my girl friend in Japan next month. Is there any way she can come to US through our marriage!?

      Yes but it we will be witnessing the dawn of the next millenium by the time the paperwork is processed.

      You have to be a U.S. citizen before you can file a petition for your wife that will be expedited. You have about 3 years to wait before you can apply for citizeship.

      In the meantime may I suggest your wife take some classes in the U.S. and apply for an F-1 student visa.

          i also got one more question.

          people mention you can spend full 2 and 1/2 years first. you then can get out of US and make sure come back every half year till the fifth year, you then can apply citiaenship. is that true?

            Yeah, but be careful or you will lose your greencard through abandonment. If I were you I would not leave longer than 3 months.

              While it is true that 4 yrs 9 months PR makes one eligible to apply for citizenship, there are also substantial presence tests that have to be met. Spending extended periods of time out of the country can impact that test. Better consult the "Guide to Naturlization" on the USCIS web site to become apprised of all that comes into play.

                  Check the direct consular filling with US embassy in Japan. You could probably file I-130 there ... but check it first. They say you can be also a resident, not just a USC.
