TPS First Offenders Act

Are you still eligible to file for TPS but were convicted of 2 misdemeanors under the first offender's act?

I plead nolo contendere to 2 misdemeanors but did so under the First Offender's Act. I was able to have the record expunged but now I'm not sure if I can still reply that I have no convictions.

Any thoughts or suggestions are greatly appreciated!!!!

For immigration purposes, you have been convicted; it is irrelevant how said convictions were handled at the state level.

You may be eligible to apply for TPS...but, whether TPS will be granted is unknown.

If either of the crimes involve moral turpitude, you will be deported.
