    Dear sir

    I have green card since last 5 years. I got engaged to my fiance (who is in USA on F1 since last two years) in India in November 2004 and had planned an immediate wedding the following year. As per our CPA 's recommendation, I filed a tax return for 2004 as "Married jointly" (Still havent filed for 2005 tax return). However due to unavoidable circumstances our marriage has been postponed to Decemeber 2006.


    I am applying for American citizenship this month. However I am confused as to what should I write about my marital status. Suppose If I write that I am single, would the immigration people check 2004 income tax return and cause any problem in my citizenship application?

    Also If I show myself married how do I prove it as both me and my fiances passport(recently renewed) show marital status as "unamarried" .

    Please advice on the above issue.

      Find a new CPA and make amends to 2004 taxes ASAP. Be prepared to pay taxes owed and penalties.

      This is a problem not only for your immigration / citizenship situation. Take care of it.

      I wouldn't recommend applying for citizenship before you sort out things with the IRS.
