If he is was inspected at a port of entry then he can adjust status here, if not, and slipped in without a 1-94 then he will have to go home to file, but you will have to consult a lawyer.

I would consult a lawyer in your case. I think if he would go back to his country, this would trigger the so called 3/10-year bar (one of these nonsensical obstacles in the US Immigration Law), that in the end backfired and actually forced people to stay out of status.
If you are married, I think he would be able to adjust via I-485 here without leaving.

I am an American Citizen, and I am married with an illigal immigrant for 3 years.He lives here for 10 years, does not have any problems with the justice. My question is if my husband returns voluntary in his country of origin, will he be able to come back without any difficulties? Is it possible for me to apply for him to come back legal?
