  • Question re: I130 screw up

    Hi Board,
    I have a friend who filed an I130 (a couple months ago) for her husband and did not send in any documentation (copy of b. certs, marriage certs, etc.) with it because she did not have the instruction sheet. USCIS sent her a receipt letter. What do you think???
    Should she send in the docs now, or submit missing docs at the interview? Not sure how to advise on this one....I also wasn't sure if USCIS will send her a missing docs checklist....

      USCIS has recently modified their guidelines on RFEs.
      They may or may not issue RFE (depending on what the current guideline and case is).
      She should try to reach by phone the USCIS office where the case is being adjudicated and speak to an Officer.
      She may also consult an immigration attorney.

        I will concur with Mike. However, if you send the additional documents, include a copy of the receipt notice so that it gets to your file. What may happen if you do not do this is that SUCSI will send you a letter asking for more information. Technically, the I-130 should have been sent back with an explanation of why, but that is besides the point.
