    Hi
    a friend of mine i687 case was denied 1 year ago but now he got a letter from uscis giving him the right to appeal against the previous decision.

    my question is while appealing his case can he still apply for work permit and travel document.?

    i will really appreciate your help and cooperation.

      Hi Shan,
      U said it was denied one yr ago, ur friend never appealed against it. And he just got a letter from uscis. Is this lulac or css case. Can u give some detail plz. Thank you

        honestly i really donot know the difference between lulac and css.? can you plz explain

          Thnk u for responding back. Chk with ur friend if he applied as lulac member(entered w visa in 1981) or CSS applicant (entered without any inspection in 1981). Also, why didn't he appealed against d decision and when did he receive this letter and exactly stating wht. U can ask ur friend to visit this website, he will get really good help from so many of us who are going thru d process. If he has to appeal he should do it in 30 days and yes he can apply for work permit and travel doc. In wht state does he live in? Good luck

            it was css and the letter says u failed to appear in your previous interview thats why he was denied now they are re-opening these cases again giving all the applicants a right to appeal.

            he is in new york
            so he can apply for work permit and travel doc ....great thank you so much for your help i really appreciate it.

              Thnk u for responding back. Make sure u appeal within 30 days otherwise u'll lose ur privilage.The other thing is wht form did they ask u to fill I694 OR mentioned some other form. Pls. advise.

                they gave him 90 days to appeal and as u said they send him form i694 to fill
                and another thing pearl what he suppose to write in his appeal.?

                  Well tht's a good news! I guess something is coming up for CSS cases. I hope they reopen lulac too and give people chance to appeal. Like in my case they even took $545.00 Filing fee and appeal was rejected not filed in time within 30 days. Which is ridicolous. Anyways, he needs to write whatever the truth is and why he is appealing the denial decision made by USCIS. Make sure he files within time limit and then also can apply for work permit too. Good luck!!!

                      Hi Shan;

                      The appeal is normaly legal arguments (rebuttal) presented to the objections made by the USCIS in earlier instance.
                      Ask your friend to get some legal guidance in the matter. Simply writing an essay statement is not enough.

                              Shan,

                              Have your friend think very carefully before opting to appeal. The USCIS never does anything nice. If they sent this letter it means they want you (or him) to appeal. Why? Simple, if you were just denied by your local office, you are protected against deportation under the CSS/Newman/LULAC settlement. BUT, if you get a denial from the AAO, that’s considered a high court, and final notice of ineligibility, you therefore are deportable!!!!

                              Know this, out of the 9600+ filed appeals 0% were approved. 100% were either rejected or dismissed. That means denied….
