Entry without Inspection- possibility of Waiver? -married to USC in Mex

  • Entry without Inspection- possibility of Waiver? -married to USC in Mex

    here's the issue- mexican male married to u.s. citizen female in Mexico in 2002. Marriage certificate lists wife as Mexican (she has dual citizenship, born in US to Mexican parents and returned to mexico to live as a teenager). Wife came back to live in US after marriage. Husband came illegally with a coyote over border shortly thereafter. Wife and Husband had child in 2003 in U.S. and is now pregant with second child. Wife works for trucking co. and has good job. Family would like to stay together in U.S. Husband has no criminal record here or in Mexico. Husband states in about 1998 he tried to cross border in Tijuana and was caught 6 times and brought back to Mexico but states he had no ID on him.
    Everthing I've read states unless he had a petition filed before April 30, 2001 (which he does NOT) he has no chance and will have to leave the U.S. and be banned from returning for 10 years. Is there any sort of waiver for this?
    Any help would be greatly appreaciated as this is a nice family.

      2 illegal entries after a date in the late 1990's and no waiver. you would need to check that.

      He will have to leave if you go this route, he needs to attend the Consulate interview and await the outcome of the waiver.
