  • Change from H-4 to F1

I have been studying full time since June 2004 under a H-4 visa and have to change to a F-1. I will be completing my studies Aug 2006, will I be eligble for OPT since I will not be a F-1 student for a full academic year? I have been a full time academic student under H-4 for over 1 academic year, but not under F-1.

My first inclination is to tell you no you have to be in F-1 status for an entire academic year to qualify for OPT. HOWEVER, I do think that if you were otherwise maintaining fulltime student standing but in another status you MAY be eligible. In the end it is up to your school's DSO, so make an appointment with them and ask if they think it is possible.
