it would be a bizare situation that he would be denied to be able to complete fingerprinting. I was just saying if for some crazy reason it happened he had options.\

Yes termination of status and and eventually NTA would be issured. that NTA could take up to 3 years or more to generate with their backlog. In the meantime. he could start entire process over and pay the fees and be approved . There would not be any pending applications becasue the 751 would have been terminated. This is" over the top" of course, but technically correct. </div></BLOCKQUOTE>

So you mean start a brand new I-485/I-130 with same USC spouse then? If that's case, the new i-485 would have to say that the alien is in removing proceeding right? How will such I-485 be looked at by USCIS?

yep he will be in removal proceedings and the 485 will be adjudicated by the Immi Judge .
      standard procedure .

uscis will know what the circumstance is. just money out of pocket for alien and spouse.

        Thanks 4now,

My i-751 case is still pending at TSC since 3/07, I am worried that I made a mistake by putting my name down on the application as Firstname Middlename Lastname. The biometrics is done in 4/07 also as Firstname Middlename Lastname. However, the problem is that my legal name is just Firstname Lastname. The birth certificate and greencard are the same, just Firstname Lastname.

After I came to the US, I adopted an American name as my middlename. It is on my driver's license and SSN Card.

On the i-751 form, I also left the Other names used field blank.

Do you think this is going to be a problem for the i-751 approval?

        Thanks for your help,

I had my biometric done on DEC 7, 2007 and it has been 3 weeks and still no green card. Should I be worried? How long does it usually take them to process the green card after the biometric is done? Is calling the toll free number any help or go down to where I took my biometric location and ask them? Any comments is welcome.

Your application has to be adjudicated.

Be patient. You will receive an approval letter in the mail .

There is nothing to worry about.
