    Here's the scenario: While his removal proceeding was on appeal, he filed for labor certification after a company was willing to sponsor him. There was no word yet about the pending labor certification application but the decision from the 9th Circuit came out against him.
    In the absence of "bag & baggage" letter, he stayed and while he remained in the US applied for immigration to Canada. His application was successful and he is currently in Canada as a permanent resident. Question: What happens if the labor certification in the US is approved? Can he still pursue it and can he continue the process through his US lawyer while the guy is in Canada?
