Does anyone familiar with R visa? my officemate has R visa, and it expires last week, he did not extend it, bec. he is going back to his country (Holland) in 2 months. Is R visa exempted in 3 to 10 year ban?

The R visa is not exempted from the 3 and 10 yr bars. However, he would not be subject to the bars if he departs in 2 months time. For the 3 yr bar you would have been unlawfully present for a period of 6 months to 1 yr. and for the 10 yr. bar ..1 yr and more. However, any unreasonable overstay of his current visa may affect his chances of obtaining a visa in future.

Remember that once he overstayed the visa, that visa will never be issued on his passport.
