    If the person leaves under Voluntary Departure, when can they come backto the U.S.? If they can come back, will it be a problem that they have an I-130 petition from an LPR spouse pending?

      much of that depends on how long they were illegal, what other crimes they committed, where and for how long they worked illegally, etc.
      A spouse of an LPR normally has a 5 year wait from the filing of the petition before any GC can be given to their irresponsible dirtbag illegal spouse.

        In this case the person entered legally but did overstay their visa for more than a year. On the other hand the LPR will become a citizen next year. Could she come back as a visitor at least and go back when the I-94 expires?
