    He entered the US on a student visa, but it expired during our courtship. We dated for 7 months and married. This Oct will make 1 year. He received his temp 2yr card and SS# in March or April. Things are very unstable now and I was considering divorce but have the following questions:

    1. Do I need to get a special Attn for this divorce process?

    2. Will I need to contact immigration?

    3. What process/steps will I need to take to dissolve this marriage?

      Hi, Valorie. First things first, please edit your question with the words "Immigration Law Question:". It ensures you only get relevant answers.

      You can divorce your husband the same as you would any body else. Retain an attorney and start the paperwork.

      As far as immigration goes, you could send them a letter and tell them of your divorce. Do you suspect fraud and have strong evidence of such? If so, then you can withdraw your sponsorship and give them that evidence. Otherwise, he can remove the conditions on his own using a good faith waiver. He would need to prove that your marriage was entered in to in good faith and dissolved naturally.
