    I am married to a US Citizen and currently in the process of adjusting my status to a permanent resident.

    My US spouse uses the Food Stamp for my stepson.

    Would the use of the food stamp be considered a public charge thereby denying my application for adjustment of status?

    I have been informed that recent decisions of some USCIS offices (especially the Houston, Texas office of USCIS) have been adverse to US spouse who use the food stamp.

      Your spouse, being a USC, can use any benefit he wishes.
      And your stepson, NOT YOU, is the one who benefited from public.

      But, as an immigrant sponsor, your spouse must show that he will be able to financially support you (file Aff. of Support).
      He must generate required income to meet the eligibility criteria.

      USCIS isn't GOD and can't arbitrarily deny the case, but will rightfully do so if your spouse doesn't meet income guidelines and there is no other sponsor to sign Aff.of Sup. for you.
