    Here is the situation, approx. 18 yrs. ago, I was arrested for solicitation. The outcome was a conditional and unconditional discharge. I was never finger printed, did not serve any time, etc. The condition of the discharge was to stay out of trouble, have no police contact, etc. for 2 yrs. I did just that. On the forms for immigration, they ask if you have a criminal record, what should i answer? and to bring proof, what would i need? A transcript from the court hearing? or????? Please help

      Which form? IIRC they ask whether you had been arrested/detained or something thats worded similar to that.

        No, that's NOT what the form asks you. If you are talking about the I-485 it asks you if you have ever been arrested, cited, charged, indicted, fined or imprisoned for breaking or violating any law or ordinance, excluding traffic violations. So the answer would be yes.

          BronzeLady,,,,, so based on your answer what proof do i need to supply to show that there was in deed a discharge of the charges? Also, would it be in my best interest to hire a lawyer, or is it realistically doable on my own?

            Go back to the place where you were arrested and the court that had jurisdiction. They should be able to give you a copy of your conditional discharge and proof that it was permanently dismissed.

              If there are no records they can give you a statement of that as well.

                one instance of prostitution is waivable so it shouldn't be a problem.
