  • Pending I-485 and Leaving Employer

    Hi!
My application for the Employment based green card (I-485) was sent in this summer when the numbers became current. I have received my EAD and AP docs & card, and I was wondering what would happen if I decide to switch jobs?

Since my application was filed almost 5mths ago, I have been thinking of leaving my employer (who filed for me) what happens to my green card application then? Can I be denied?

You may switch your job using AC21 only after 180 days from the receipt date of I-485. It is much safer to switch when your I-140 is also approved, as that can be revoked at any time and may create hardship in future.

Also you may need to have in mind that the job offer which you may take should be "Same or Similar" in nature.

It is better to consult with an attorney and take decisions appropriately.

      Thanks
