    A friend of mine got his immigrant visa from the american consulate back in 1979. He did not use his visa and returned back the papers. He did keep a photo copy of the immigrant visa with him. In all these years he travelled to US for a pleasure trip two or three times. His question is "Can he get immigrant visa in lieu of that visa which he returned back?"

      An immigrant visa must be used to enter the United States within six months of being issued. After that time, it automatically expires. Your friend cannot obtain a new immigrant visa in lieu of the one that was issued - but unused - in 1979.

      If he currently qualifies, through the necessary sponsorship, he may reapply for an immigrant visa.

        The formarly approved petition will work or will he has to start from scratch?

          The formerly approved petition has already been adjudicated...in 1979. The immigrant visa obtained from said petition expired six months after it was issued because it was unused.

          He will have to start from scratch, assuming that he still qualifies for sponsorship for an immigrant visa.
