  • Please kindly advise us? Thank you!

    Dear Board;

    Can you please, advise us on the following issue. I have a friend who came to the U.S. illegally, by crossing the Mexican border. One of the prominent immigration attorney's in this country said that he can apply for Asylum and AOS. Is that possible to do so, or the lawyer just want his money for this case?
    Any advise and help will be appreciated.
    Thanks a lot for your time.
    Regards,

      Did you friend come because he's really fleeing persecution? If so, he may have a chance.

      However, if he's been here more than a year without seeking asylum, he'll probably have problems. Also, he came through a "safe" third country (Mexico) which suggests that he wasn't so much as fleeing from his home country, but fleeing to the U.S. specifically.

      Note--I'm NOT a lawyer.

        See the following for information on applying for asylum. Note the "bars to asylum" on p. 11.

                    He is a member of opposition party somewhere in European country and fleeing from the home country Government persecution, torture and imprisonment for life.
                    So, he runs to freedom ( America ) in hope this country will grant an Asylum to this individual and his family here, protect them from persecution,even he is crossing the Mexican border to come here not having any other legal ways to get here.
                    As we were told, many applicants for Asylum were granted this status in a similar situations.
                    Any advises will be greatly appreciated.

                    Thanks for your time everybody.

                        Tell us what country he is from then we can be able to determine whether this lawyer just wants the money or knows his job. Asylum cases are not as easy as people say they are. You will need real proof of persecution. Photos, scars, the works. You have to be in real danger not hearsay danger. You will be required to narate stories that happened to you as an individual with proof. The one year window can be overlooked if you manage to convince the Assylum Officer. Check out the USCIS website and see the statistics on how many people were granted asylum in 2003. Give us the details if this is a real story.

                          The statistics will be on people from his country granted asylum.
