1. The Vermont office is NOT going to accept anything from the accused abuser if they already accepted the VAWA. You can write to them, but by doing so, you'll just fast-forward the approval of VAWA for the victim. Also, most of the time, if the victim gets the restraining order against the abuser, she also gets the permanent injunction prohibiting the abuser to contact any authorities in regards to her petition(s). If that happens, you'd be violating the restraining order, and you end up behind the bars.

2. The few officers that handle VAWA applications are very well-trained and are capable of screening the applications.

When you submit the form, they check the submitted documentation for complitness and proof. If it is lucking any sense/evidence, they'll let you know/deny it.

In reality, these officers are highly trained to process the files and, to be honest, they DO have a profile of a US male who "imports" the girl for himself. And to be honest, the picture of such man is Not good. Just like women coming here are labeled "mail-order brides", the guys, who bring them here are seen as troubled individuals.

3. Threats to deport the foreign spouse and desire to harm her/him in any way in regards to immigration is one of the strongest grounds for VAWA approval.

4. Per new 2005 VAWA laws, once the VAWA is filed against the abuser, it is on his record and, if that person applies for a new K visa for a next bride, the immigration officer has to investigate his background further prior to making a decision on the petition. And yes, that legislation went into effect for the sole purpose to drastically reduce abuse and prevent the chronic abusers from harming more women.

Also, upon receiving the K visa, new girls would be getting a little book with emergency information on what to do and how to contact the authorities in case of the signs of abuse from their partnet.

Bottom line, Chubby, you have to weigh all the potential damages before you try to retaliate. Unless everything she wrote on VAWA is a complete BS. In such case, consult a lawyer.

Now my friend, just because your wife cheated on you walked out on you with a different man,does not make it fraud...fraud is very hard to proof...and the only way to proof fraud is,when your wife marries,right away after you guys got or get divroce someone else,just to make sure she stays here...thats a red light on ins....because a normal person does not re marry right away a new person after a divorce lol...

so you have to proof it was fraud, and how are you gonna do that? if u consider,cheating etc is not fraud...

but then again,thats what happens when you marry a S-K-A-N-K, you harldy knew...

There are many normal persons that remarry immediately upon divorce as a result of infidelity throughout the marriage. Are they abnormal? I think not.

I agree. The issue is to be able to present the information to USCIS in such a manner that the Service also has sufficient doubt as to the intent of the alien upon entering the marriage. There are many ways to prove fraud. Adultery from the inception of marriage to another person could be satisfactorily argued as one. Will this be sufficient to convince USCIS? That depends upon the evidence available to support the allegation.

VAWA and Marriage are for the good of Humanity and for the real victims not the misusers and false applicants that take advantage. It is those foreign individuals with corruption, evil, and sadistically bad intentions that devour innocent US Citizens that fell in love with the devil and found out their lives become a living nightmare and are cautious because of being falsely accused and served BS. The difference is there is a baby involved that I do not know information about or permanent residence; therefore now a US Citizen baby is living a life of an illegal alien hiding in the shadows of society. Oh no, it's not like that at all. I still think about the whole situation (and her) at least once or twice a day. It'll forever be a chip on my shoulder, just as for her as well.

But see, hers is worse than mine, 'cause she ended up having to go back empty handed. A Dr. at that too.

In other words, A FAILURE to herself, her whole family and her friends.
