It matters not what penalty she served, but the penalty the conviction carries. I recommend she consult a good immigration attorney.

Hey..just wondering if anyone has heard of cases like this being over turned or what a friend can do......a good friend is being deported because back in 1990 she bought something stolen which is considered felony theft..(in TX if you buy anything over the value of $750.00, it is considered to be a felony) and the INS says if you receive 1 felony within the first 5yrs of having your green card, you can be deported. She only received probation for this crime...She got her green card like in 1987-88. Until now, she was going back and getting annual renewals on it. She wanted to find out the status for citizenship and was told her file was sent to Washington. When the file came back, she was taken into custody and told that since she received a felony, she will need to go to a deportation hearing (most likely be deported). Everyone I've asked has said they are deporting people left and right even though this crime happened over 16yrs ago and she has done nothing since then. This woman is 55 years old, separated and has no family in the country she came from if deported. They family she has here are citizens of United States.
HELP!!
Thanks
