    i'm new here and would like to know more informatin. Hopefully you all will help me out.

    I came to US 12 yrs ago under F4(my mom's brother sponsored for us) and we were devastated and didn't apply till 3/2003 eventhough our priority date were current on 8/2002. Last month my mom received a greencard but i were denied b/c i were aged out. People told me to file an appeal

    I've done alot of research and noticed an appeal would not help me at all cuz there is no evidence to support. However, i might retain my priority date from the old petition. However, if my mom file a petition now is it gonna be I130 or 485??? and how do the service center or local office know that i would be able to retain original priority

    if anyone know about this?? if you do,, please drop a message for me. I would appreciate it alot

      were you over 21 at the time that you filed the I-130?

        I mean the I-485.

          yes, I were 23 at the time my priority date was current, that was 2002

            You do not retain the original priority date on the first I-130 as far as I know. Your parent must file a new I-130.
