  • i601 Waiver of Inadmissibilty Delay here in U.S

    Hello everyone,

    I'm new to the forum, but I need some help, I'm an allien who married a USC, I had a conviction for receiving stolen goods about 5years ago, (for which I got a monetary fine, no jail time) so I was told i would have to file a waiver of inadmissibilty, we filed an i485 and i601 together last year. Me and my wife went for an interview last year and I'm yet to hear back from the INS. Its been almost a year. I keep talking to my lawyer but she says all we can do is wait. We haven't received no approval or denial, no response. I heard that waivers might be quite difficult at first try but I love my wife and wanna be wit her forever.

    Is there anything else I can do? Should I get another lawyer? or would I just be wasting my time? Is it common to be delayed by this much time here in the U.S

    Please advise.

      I am in a same situation I am still waiting for approval. I ahd a interview back in Jan still have not heard anything finally I got response last Monday that they are checking my name in FBI Data base. Asking us to contact them in 120 days.

        Did you do anything generate a response from them? Who are you supposed to contact, the local office, infopass or the 1800 number?

            we had our interview back in November 2006, and we were not even allowed to submit our waiver yet, they said more information was needed.
            I contacted our senators office and their immigration representatives contacted the consulate on our behalf, and we were told that they were still investigating, and our case was under administrative review.

            Also, they did the FBI fingerprint and name check when we had our interview, did they do that for you or your spouse?

              Call the state department visa line (202) 663-1225
              they can give you the status of your case.
              Also contact your senators office (for your state) and have their reps contact the consulate that you had your interview at to get more information

                I believe my position is little differant the others. I was convicted for misreprestation back in 2003 then I was on preceeding for almost two years front of judge to wait for I130 to get adjudicated. INS neve found my package. Judge waited till last year and asked the both parties to decided what they want to do. Finally INS prosecuter came to my attorney and made a deal to end deportation preceeding and send me back to front of service center. This jan I had an inteview in dallas. Adjudicater asked me more documents to submitt since they have old style pictures. I did not had medical done and new I601. We submitted back in march and still waiting for response. Last monday we got the response FBI is doing a name check. Does anyone knows what is means. I saw on website that name check is differant then background check. INS already had my fingerprints from last year....Any ideas do you guys think it will get approved.

                  I just talked to a Rep from my senators office, and from what the state dept told her is that the name check goes through 15-20 different companies. That there is no way to see how far they have gone, or how much longer it will take, and no one can make it go any faster. Average wait from what I understand is around 15-18 months...

                  What I dont understand is why they didnt do this way back when we filed our I-130 3 years ago, so that my children and I wouldnt have to sit here separated from my husband for so f*ing long. It is like they want him to try and cross the border again illegally just so they can throw our case away....

                    I guess I will contact the congressman for my district and the senate office. Hopefully I can get some response. Does anyone know some really good lawyer in Maryland?

                          Would it be advisable to get an advanced parole to travel while this case is still pending? I dont know becos of the inadmissibility issue.

                          Does anyone have any experience with this? cos i really need to travel.

                            They have my waiver since Feb 13, 2007, went to Athens then transfered to Rome On May 30th 2007, nothing ever since...

                            They emailed me indicating that its in the background check since Dec 07 !!!!!!!1
