  • I-485 interview ... what to spec?

    I'm planning to file an AOS for my 18 months son.

    I'm US Citizen and he has an L-2 visa.

    I have heard that the AOS procedure finishes with an interview done by INS.

    What should I spec that interview to be like?
    What questions they might ask?

      You are a U.S. citizen by birth? Are you sure your son doesn't qualify for derivative citizenship.

        No, he is not USC even though I am.

        The law says:

        "For children born on or after November 14, 1986, a child born to
        one U.S. citizen parent and one alien parent would acquire U.S.
        citizenship if the U.S. citizen parent was physically present in the
        United States or its outlying possessions for at least 5 years, at
        least 2 of which were after attaining the age of 14 years"

        I only lived in US for 8 months.

        He cannot be USC. That's the law.

        (Actualy, when a USC take his/her child to a US Consulate to ask for a visa, the US Consulate check first if the child has any chance to be USC, after that checking is complete they gave the visa ... any kind of visa stamped to a passport is a clear sign that the person could not be a USC)

            your son?

            2- How come you only lived in US for 8 months?
            3- What is your place of Birth?
            4- Where your birth was issued?

              Because I didnt live in US the time required by the law (see above) to make my son USC.

              2- How come you only lived in US for 8 months?

              My parents where LPR when I was born. Eight months later we moved abroad.

              3- What is your place of Birth?

              New York City.

              4- Where your birth was issued?

              New York City.
