  • PLEASE HELP US! We have a very complicated situation.

    Last year, I got married to a filipino woman who came here in U.S. via K1 visa - she didn't get married to the person who petitioned her and the man didn't buy her ticket to go back to Philippines after that 90 days. So she came here in California where we met, got married and had a baby. Our son is 8 months old now. I wanted to know if there is a way for her to get a green card. We applied before but the lawyer who handled our case just wasted our time and money because IMMIGRATION didn't accept our paperworks. I don't know whatelse to do. - PLEASE, I need as many advise as I can. It would be deeply appreciated - Elijah

      Why do you feel that your attorney wasted your time and money? Unfortunately, one of the requirements of the K1 visa is that the alien beneficiary either marry the petitioner within 90 days or leave the country. They are statutorily prohibited from adjusting status through marriage to another US citizen. As I see it your option is to file for a spousal visa for your wife, while she awaits in the Phillipines. It would be wise to secure a second opinion, if you've lost confidence in your current lawyer, but I'm afraid your issue is beyond the scope of a newsgroup.

        why should we even think about rewarding or helping someone who cannot follow the rules? Sounds like this so-called "K1" was bogus; she probably paid the American to file for her so she could get to the states. Just what we need - another visa cheat and their whining supporters.

          I think the best bet would be to have her go back to the Philippines and file another K1 visa. I believe it is IMPOSSIBLE for her to adjust status. An excellent immigration lawyer can be found on the loveme.com website(Ms. Jones). Many attorneys take these cases and they are not specialists. They are greedy but immigration law is very different than any other kind of laws and they mess up. Do not waste your time by asking for any other advice. Call this Ms. Jones; all she does is handle immigration cases especially K1's. It will take 4 months to clean up this mess but I believe it is the only way; talk to Jones and let us know what she says.

            Michael,

            Too late for a K1, this person is already married. A K3, or the spousal visa (CR1) is the only route that I can think of and both require departure from the US.

              OOPS yes you are correct; K1 is for MOB's; they are already married so need a K3; I thought they were just engaged

                        For your information SOMEONE12, my wife didn't pay the american for her to be in U.S.A and be Abused by him (and I mean physically and mentally!). Even his closest friends are the ones helping her to get out and leave the guy, they convinced him to buy her a ticket back to Philippines but he refused to. She reported him to INS but they didn't do anything about it. They ask her if she have a relative in U.S and to just stay there... SO be NICE before judging someone. That is not a good attitude to start the year!

                        Anyways, the lawyer who handled our case should have told us that it is IMPOSSIBLE to adjust her status here in the United States, we could have taken the first step to go to Philippines -but NO... he was so reassuring that we can do all the paperworks here after paying him over $1000

                        Thanks you guys, I appreciate the replies. I will call Ms. Jones first thing monday morning. By the way, if I go to Philippines with my wife and son - would that help the processing time?

                          Do yourself a favor and ignore everything that comes out from the entity formerly known as Michael.

                              Michael is actually right. Overstay a K-1 without complying with its terms, you are ineligible for AOS, but there's waivers for "permission to reapply" to go with your K-3 application.
