    how an overstay is discovered.I read an article by a US attorney who said quote 'Interestingly, however, is that most people would think laws and systems are already in place to track all nonimmigrant visa holders entering the U.S. The answer however, is yes to the law part, and no to the system part. That means, that up to this point, practically any foreign national who enters the U.S. as a tourist, student or temporary worker could easily overstay his visa and evade detection'

      I don't know how they would know for people that entered without getting I-94 or I-95 --like for example, Canadians. But for other non-immigrants there is an expiration on the I-94. Oh and unless you some how get caught and can't proof your valid status. But the latter has a lot to do with luck i suppose. So as long as the overstayed person doesn't leave the country and doesn't process anything with the INS, I have no idea how they would be discovered.
