  • bringing spouse to the US

    Hello,

I recently just found this website and was wondering if anyone here may have answers for me. I am marrying an Irish citizen on December 30th of this year in Ireland. A few months ago he tried to come to America, but had a one way ticket, so they wouldnt let him come because he had no reason to return to Ireland. With that happening we have moved our wedding date way sooner than we had planned. I know that We have to apply for a spouse visa. Does anyone know how long it may take for that to go through and also, is there anything that we can do before our marriage to get the paperwork rolling? Please help, i cant find any answers on the web.

    Thanks alot,
    Julie

julie, go to the uscis website, its official for all you want to know, honey, there is alot that you need to do, dont do this without being well informed first. some of us have been waiting for our husbands to get here for years. here is the website that you will need. http://uscis.gov/graphics/fieldoffices/index.htm
be sure you read very carefully, cos one mistake can cost you a terrible amount of time. also, think about getting a good immigration attorney, this is not an easy process. you have alot to do before you go there to marry your fiance, good luck. jean

        Perhaps several months.
        Not even a year.

Before marriage, I beleive, you can apply for K/Fiance Visa.

        Consult attorney.
        This case is a cakewalk.

        Good luck!

I guess it all depends on where you want to live after you get married. If the plan is to live in the United States, I would suggest your fiance come to the U.S., unmarried, as a K-1/fiance of USC, which you would have to apply for and get approval on before he can come. Once here, you guys get married with 90 days and then file AOS.

If you go to Ireland to get married, you would have to come back to the states, and petition I1130 for him and at the same time, if he wants to wait for his green card while living in the STates with you then you have to file I-129 K-3 visa.

If you end up living in Ireland while waiting and you establish residence in Ireland you can petition for him in Ireland at the consulate and wait there until he gets his visa.

There is A LOT of info out there for your situation - I am suprised you did not find any answers.
