  • U.S. seeking divorce to her husband who isnt a U.S. citizen

    hello, i am married to an american citizen and my wife wants to get divorced.. we have been separated for 3 years, but married for 4 years..I havent seen her in ages but i know she is looking to get divorced.. we went to our 1st interview and we failed.. i did get a social security a work permit just because i am married to a citizen.. what happens if she divorces me.. will i become illegal? what can i do.. i refused to sign the papers.. what can she do to me.. please any information would be great..

      Hi! i'm not sure but first what is your status now?i mean do you have a green card? if not and you said she is filing a divorce, you can still adjust your status by applying on your own and ask somebody to give you an affidavit of support. Read the immigration info on this site. I might help you.

        no i do not have a green card at all.. we failed our interview like 2 years ago.. the only thing i got from my wife was social security and work permit.. which now i think is suspended.. and no longer good to use..
        Can she kick me out of the states.. any help would be great..

          You have no chance of getting legal status through current marriage. She can not deport you but one day you will be caught and deported. Go back to your country before the door hits you on back. If you refuse to sign divorce papers she will still get a divorce decree.

            No, you won't.
            Because you already are, as far as I understand - when you "failed" your interview, your petition was rejected, right?

            So, don't worry, divorcing her won't change anything in your situation

              There seems to be more to this story than yodayot is letting on. Please correct me if I am wrong but I thought that if your AOS is rejected then you have a right to appeal but after that if there is still no joy then you are automatically placed in deportation proceedings. Also I am not surprised that his AOS was rejected when he is telling us that 3/4 of his marriage has failed to be a marriage. This all smells like b u l l s h i t to me and it appears that we are dealing with another of Maria's fellow illegal comrades. So mate please p i s s off out of this country

                  How did you "fail" your interview? I've never heard of someone who was really married failing it. What sort of things did they ask and why did they conclude that you aren't really married. Is there a huge age difference or a complete language barrier or something? Or was the marriage a fake just so you could get a greencard? More info, please.
