  • 2nd marriage to illegal

I am currently sponsering my husband to adjust status based on marriage to me, USC. But....this is the 2nd marriage for me. My first husband was also illegal and we applied for his adj. of status based on marriage to me. Long story short, we were married for 8 years, he got royally screwed by his lawyer, and he was denied LPR. We got divorced about 2 years after his denial. And I got remarried.
NOw, I was wondering if my current husband will have any problems with INS during his interview due to the fact that I tried to petition for my previous husband.
    Any thoughts?

Thanks for your insightful answer Julie. I knew I could count on some quip.

You cannot choose who you fall in love with. My heritage is spanish and therefore I socialize with spanish people. I happen to find spanish men more appealing and therefore have found myself married to two of them. I was unlucky though that they were both nationals of other countries.
So, thanks for promoting the american man, but I'll stick with my latin lover.

There is alot of Latin lovers who arent illegal. 1 time is perhaps fate, 2 times is a pattern. Could it be just maybe people mistake your kindness for weakness ?

I am not being kind. So I doubt they are mistaking me for some dumb sap. I have been fortunate enough that both my ex husband and my current husband are extremely educated, cultured, good men. I was smart not kind in marrying both of them. With my ex, things didn't work out all due to the fact he he was too dedicated to his career and did not want to have children. AFter 8 yrs, it took it's toll. Now, I have a 1 1/2 yr old son, a prospering consulting business with my husband, and big plans for the future. So, be it fate or a pattern, both my marriage decisions have been wonderful and I feel blessed for having my husband in my life and for my the life I had with my ex. Even though they are Illegals!

If your marriage is legit, don't worry too much. Just bring the usual supporting documents (bank statement, bills, photo albu-ms, etc, etc). Over 50% of marriage in this country end up in divorce. Its sad but the favor is against married couple
One thing though, did your husband overstay or cross the border illegally? The process is different (waiver, etc) depending on that.

                  AJ,
Quick update for you. Hubby received his 10 year card yesterday! After the interviewer said 6 months to a year! He received 4 welcome letters and all had different dates and all said in 3 weeks the card would arrive. This has been the only time something came way before it was supposed to. So we are officially done for at least 3 years!

To Marmaduk: I have all the evidence, my concern isn't that they will find my marriage illegitimate, but that there was some law out there that I am not familiar with that states you cannot petition for more than one person, or something like that. On the 485, I believe, they ask whether or not you have filed for another person in the past, to write his/her name, and whether or not they received the adj. of status. Soooo, if it doensn't matter, why would they ask?
                    Just nervous, I guess.
                    TO REINA:
I am so happy that you have all that behind you. And for once, USCIS did something quickly. That's awesome. Have fun in Mexico! Tomate un tequilita por mi.

                        AJ,
I dont know what you are worried about.

A USC cannot be prevented from getting who they want here; you are the same as those USCIS people i.e you are USC as they are, why would they have an influence over who you marry?

If I were USC, I would not worry a bit. It would take very big evidence for them to find your marriage illegal. Just get your paperwork in order, prepare for some questioning and STOP worrying is my advice to you.Remember USCIS has problems with non USCIS; USCIS seem special even in the way they talk and treat people.

Non USCIS are treated with less respect by USCIS.
