  • H1B - COS regarding

I would like to get some clarifications regarding work visa status change.
I am currently working with L1 (Company A)visa, and I have got H1 from another US based company (Company B).
H1 visa was applied, without a status change (COS) by choosing Inform to consulate option.

Now I am not in a position to travel out of country to get stamping for H1-B.
Is it possible to get my status changed while I am inside US itself.
Or is it mandatory to go out of country (base country) and get it stamped.

    Would really appreciate response.

You can apply for a COS inside of the U.S. via form I-539. In addition to proof of your current status, include a copy of your H-1 approval notice and a letter explaining the circumstances. Expect a request for further evidence as I don't think adjudciators are used to this type of status change application.

On second thought, it may be easier and cheaper if you just ask employer B to file an ammended I-129 requesting the change of status inside of the U.S. Include a copy of the current approval notice. Make sure they also include a statement in the employer letter indicating that they understand that you can not begin employment until the COS has been approved.
