I was told that since I dont have my deportation notice or my denial notice I need to do a FOIA (freedom of information act) to file a waiver, Anyone with such experience?

It's G-639, no filing fees, and you can get on this site just look to your left, it's free.
If you file for FOIA, you will get all the documents including correspondences between you and the USCIS. It's really informative. That way, if there was a deportation notice--it would be in the FOIA. I went through someone's FOIA and she was in a similar situation as you. She was able to track down the deportation letter that was sent to her as well as the envelope that was sent back to the USCIS because they did not send it to the right address
