    I am married to an American and have his baby. I don't want to be with him anymore.He is not abusing me, but we fight all the time. I filled my paper for permanent residency in July, I got my work permit, I am still waiting to be called for the interview,and get my green card. Is there any way I can divorce and still stay in the U.S before the paper process is over? I don't want to go home and leave my daughter her. When is can I divorce him, and still be able to stay her, and not loose my daughter?

      Before you get your conditional green card, your chance to stay legally based on your marriage if you no longer live with your spouse is almost 0%.

        You did not give any reason for seeking a divorce. Are you just fed up with the marriage or is it because of emotional and physical abuse. If it is the later, you may look into self-petitioning as an abused spouse. If it is because you are fed up with the marriage, your chances of getting the green card is minimal

          If the marriage ended for any reason before the conditional green card is granted, IT IS A DENIAL unless there is a very very very strong.
