    Ateka comes with an important note in the discent. You however are confessing that the alien misrepresented citizenship "in order to obtain full-time employment" and there's circumstantial evidence to support an element of intent or malice; the analysis of the social security card and how it wouldn't disclose any sign of ineligibility and the fact that the alien was aware he was not supposed to obtain full-time employment.

    That's the purpose of the statute, to prevent intentional fraud and circunvention of the law in cases where aliens seek to obtain a benefit they're not supposed to receive. If you lie to the interviewers you'll make things worse. Always tell the truth and hope for the best.

    I have to note here that desire to obtain employment is not an evil motive, such as the deprivation that would occur in common law fraud. This offense, according to immigration law, is more severe and presents more danger to society than, for instance, a convicted felon in possession of a firearm or even major financial fraud against the United States. Go figure.

        Courts have ruled that if actual benefit was obtained , as a result of false citizenship misrepresentation, then the alien is guilty as charged.

            The one that was materialized as a direct consequence of false Citizenship claim, provided that the alien was not eligible to obtain it otherwise.

                Getting a job as a result of false Citizenship claim falls into that category.
