  • missed biometrics and what to do now?

    I have been married for three years and we are expecting the baby now.
    My husband filed for the removal of conditions in September 2006. I
    received NOA, a message telling me that my visa was extended for
    another year, employment and travel authorised. I have not heard from
    them since.
    Then I found out that there had to be biometric appointment. I asked
    my secretary and she confirmed that my husband received several
    letters from immigration, yet he showed me only one. I understood that
    he repressed my biometric appointment letter for some reasons.
    I do not know what to do now.
    Will I be deported? If yes, how soon? What is the procedure? Can I
    amend it? Apply again, or what to do, where to start?

      Repressed your appointment for some reason: I would want to know what that reason is and haul his *** to court for it.

      Men are really something!! They think they can control women by withholding immigration papers, hiding passports, birth certificates and the like....more commonly done by American men than I would like to see.

        I do not know either - shoot them guys (just kidding).
        Maybe use info-pass, make an appointment with an immigration officer and simply tell him the truth ...
        My husband is the same way - simply American - if something does not come streigth under his nose he neglects it. But what you can do, right? I just cannot imagine that somebody would want to deport a loving, pregnant wife of USC! You did not do anything against the law, you just did not receive the letter which was adressed to you (and if somebody detains your mail it is a felony, a federal crime). Even immigrations officers are humans and you have enough proof you marriage is for real (I think the baby-to-be is a big proof by itself). So just take it easy and try to talk to them and explain to USCIS officer what happened. I would say this is the best way .... I would do so if I was in your shoes.
        Just one joke to cheer you up: "A lady comes to a tarot fortune teller to find out about her future. The fortune teller draws the cards and says - madam, I have a terrible news for you; your husband is going to die withing a few days. And lady replies: yes, I know that but the reason I came here was to find out if I will go to jail for killing him".
        So I hope just some fun will make you smile :-)

          something is not right here. One side you said your husband filed for Condition removal and other side you said Visa is extended? condition removal is for alien who married and got Conditional GC. ther is no visa extension.
          Finger printing appointment only comes when there is NOA on the petition and FBI report and two other reports will be look at in the same time.
          You can be deportable but it will not occur unless NTA will be issued to you. DHS not just pick you up and deport you. there is a procedure they have to follow so you should not be worry right now.
          You can get another appointment .. talk to your attorney.
          Its a discussion, not a legal advise..

            I received NOA which said: "Your visa extended for a year. Employment
            and travel authorised. Your case is being processed. If you do not
            hear from us for 6 months, call..."
            I thought it was all. Then I found out that know a biometric
            appointment was mandatory, thought I had one when I came here. I asked
            people, they said that it usually arrives 2-3 weeks after NOA. I then
            asked my husband's secretary, and she said that he did received
            several letters, but showed me only one.
            I never went to that appointment and we sent papers in September 2006.
            What is NTA?

              Why would YOUR secretary know this, but not you?

              And not only know it, but withhold it as well!
