I've been offered a good role in the US, and my company have completed all the paperwork for a L1A visa, they are very confident I will get it as they do this a lot.
Trouble is that I have a complex, albeit legitimate immigration history.
I studied in the US for around 10 years when my family lived there, and once when returning to the USA was forced to withdraw my application to enter and returned back to the UK.
I was asked to apply for an F1 visa, which I was denied 3 times and then later banned from entry for ten years, they thought I was not enrolled in education. When I later proved that I was, they they overturned this decision and I now have very official paperwork to show that I never was illegally in the US and never overstayed or attempted to do anything illegal . This was 6 years ago and I since been denied a B2 for having not enough ties to the UK ( which was fair)
When arranging my interview they asked me if I had been denied entry, I said yes and had to complete a VCU-01 form.
I was pleased to get a note back 24 hours later to say I could arrange my interview, but when doing so, was told I would be meeting a specialist VCU interviewer and the person on the phone tones suggested that this would be a very significant thing, even saying, well IF you are lucky and IF you get a visa, then you should get it 4-5 days later. When I did not expect this tone.
Questions.
What is this VCU interview, is it any more scary that any other interviews?
Does everyone regardless of how significant their denial of entry was get this, or I am in a tricky situation already?
If anything goes wrong, will there be any kind of appeal process I can use, all this situation has been from the US immigrations fault in banning me for 10 years incorrectly?
If I get the L1 , when I get to the POE, should I be OK, or will I be still at risk of being turned back since they may still have me as a problem on their system?
I've spoken to my immigration lawyer, and they seemed to think it was all fine, but said they'd never heard of a VCU- ( so thats not that helpful)
Really appreciate any help, I am very nervous as this opportunity in the US is amazing.
