my fiance is currently in the u.s. on a student visa but was rejected when the cap was met on the h1b... his visa doesn't expire until may.. what do i need to do in order to keep him in the country legally and able to work?

What does student visa have to do with H1B? Please explain as they are two different types of visas.

his student visa expires in may, and since he graduated with his b.a., he wishes to work until he goes back to school... he wanted the h1b because his firm was sponsoring him... i live in tx, he's in d.c. the only reason i haven't moved in with him is because of surgery and school... will this be a factor when filing?
