  • F1 visa holder working illegally and getting pay illegally

    How can I stop them?
Several friends are trying to apply for parttime job from gas station, restarunt , hotle or shops to pay the higher tuition fee (It become harder and harder to get scholarship or finacial suppport from universities ) they found themself got rejected or offered unbelievably ultra low salary. Laterly, they found those position are filled by their foreign classmater who hold F1 visa. In fact, they get scholarship from university(plus out-state tuition waive, over 20,000 dollars) and benefit granted to full time students from univeristy like low rent university apartment for students, while these friends are all in two years waiting list. These foreign students are all muslim and come from Bangldesh and Pakistan. They got these job and got payment in cash, which means they donot need to pay taxs for around 1000 to 2000 dollar they can earn in one months. They got these job for they have the networks of relatives, friends, and countrymen. It also is found that more and more gas station, hotel ,shopr run by people from those muslim countries. In fact, these people are more united and better organized. Facing unfair competation, we lose opportinities in education , job and future.

What should we do to stop them?
report to INS or IRS ?
    How to do it ?

how to make a call, to whom ?
        more detail instruction,please.

I cannot find the phone number or mail address from the website of Homeland Security in Texas.

They are not illegal immigrant ,full time students holding F1 visa. but surelly, they broke the law.working outside school and geting payment in cash. Those muslim students may have some ownship of the store they work for.
With time , we can anticipate that more and more muslim will pour into this country in this way ,resulting what they are doing to French nowadys.

We are really pissed off .

Call IRS and report the employers. They should be filing a I-90 for each employee and paying taxes for their employees. The IRS will deal with them quickly and efficiently. It is not immigration's job : )

You could call ICE @ 1-866-DHS-2-ICE.
            http://www.ice.gov/graphics/index.htm

Technically, they're the enforcement arm of USCIS.

              Thanks for your suggestion.
The Geting payment in cash are subjected to IRS. It is also known that these F 1 visa holder cannot work for they are registered as full time student and should have resolved their fianical support resource before they come here. They difinetly break some law I just donot know. There should be some law enforcement we can resort to beside IRS.

Its ICE (more specifically DRO) job to apprehend them. Here's a listing of their local office:
                http://www.ice.gov/graphics/dro/contact.htm

OTOH, F-1 visa holder can work outside the campus, as long as they've secured permission from USCIS. Its completely legal.

IRS is really your best bet because they get really hostile if they find out that you are not paying taxes and they swoop in fast!! And everybody gets it - employers and employees. They will in turn go to ICE if they find that there is anything illegal including immigration. And even if they have permission to work - if they are being paid in cash under the table -the IRS will 'fix' it. ICE doesn't care so much about taxes.

F1 Students can work. How did you get to know that they are getting paid cash or that it is illegal? Whats it to you?

IRS won't even share their data to ICE with regard to illegals. What make you think they'll go to ICE now? Afterall, its ICE jobs to catch immigration violators which is what these students are being accused of.

F-1 students can work outside campus, but only after granted permission from USCIS. Most usual reason is financial hardship, and even that one has a slim chance of approval.

Thanks for marmaduk, dragonlady's suggestion. As far as I know, they donot get any permision from USCIS. It is hard to get permission unless you can prove you meet unresolved fianical problem in emergency. The visa officer should have screened these F 1 visa holder in terms of fiancial support and immigrant intention. In theory and acclaimation they made before visa officer, they should have resolved their fiancialsupport problem before they come to USA. F1 visa is issued to full time student, not to a worker even a half time one.

They get paid in cash for their jobs are illegal and not listed in Payroll. In this way, their employer also save money in insurance retirement plan like 401 k. You can find they soldom use any credit card and pay everything in cash, a part of underground econimics. They mailed a lot of money back every month to their country ,maybe to get more people come here. It is like chain reaction.

I prefer to be an anonymous reporter for I am really afraid to be thoughted as an offender or discriminater by their local muslim community if some guy release my name to them etc. You know, they are connected and organized and they called them each other brothers and sisters in their meetings and parties. If someone sent back due to my calling, revenger will go after me .

It maybe is why everybody here know they work illegally and get payment illegally ,but no one take any actions, even their illegal activities have done harm to our education, job and free market system. Who want to get trouble and get no benifit from this kind "unfamous" reporting .

Like some other folks on here have said - F1 students sometimes ARE allowed to work off campus - legally - but yes - it is rather not common. CIS just issued some new info for students who were in the hurricane zones - and basically some of them will be getting permission to work based on certain circumstances - but then - that is different.

However, based on what Clancy wrote - if true - it is wrong. I am an F1 student and I kno its hard finding the cash to pay the fees they charge us to study here. Its like they are trying to deter us from coming here. So its wrong - but sometimes people got to do what they got to do to survive. Rosa Parks broke the law back in the day and she was jailed - today she is being remembered as a "hero" for breaking the law. It's an ironic situation. I am NOT condoning it - but sometimes when your back is against the wall - you gotta do what is necessary to survive. The US should probably institute something like in the UK where they allow intl students to work - because seriously - in this day and age - how many people got $US80G put aside to send their child through college for 4 years ?? So this request of a bank statement with tons of cash is **** - and we all know that it usually is there one day - and gone the next - its life - called reality. SO CIS needs to get real with the requirements that they ask of us....

Somewhat I agree. Even Americans are getting a hard time to pay for ther school what more to individuals who are not a citizen of this country? Illegal people does the dirty jobs which american refuse to do. Would u like the job they have in a gasoline station? thats why you want to stop them?? You don't have to stop them, you just have to improve or better yourself otherwise you will become parasite as 65% of americans already are. Its not unfair when u see them working as illegal and getting better grades and having a lot of achievement.
