  • Over stayed in 1978

    My husband over stayed his stay from 1978 and was a fruit picker. He was also under deportation about 7 years ago because of an aggravated assault charge. They released him with a slap on the hand and 6 months of probation where he had to go to the immigration office monthly. Does this mean he is off the hook now? Will they still pick him up for deporting? Can he get help from a lawyer?

    By the way my husban is on disability and has a medicare card, but lost his SS card.

      it appears to me that somewhere in the immigration system the ball was dropped,how did he get employment authorization,it puzzles me how he also gets disability and medicare when he is apparently illegal,to be eligible for disability and medicare you have to have so much credits from work history,plus you need to be USC or LPR.I have been wrong in the past though after all i'm human.

        I do not know, my husband does not read and write, and so I am not sure what happened. He also does not care to try and remember too much about that time back then. I think he was working illegally maybe? I dont know, but his Immigration file has no paperwork filed for nothing except the deportation review.

          Has he been here continuously since 1978?

            yes my husband has been here continuously since 1978, he has not left, nor has he attempted to leave

              how come your husband did not file in 1986 when an amnesty for illegals was passed? Anyone who came to the U.S prior to Jan, 1, 1982 were eligible to adjust status to permanent status including migrant workers. Too late now for him.
