taxes ...or not?

hey ,
maybe you knowledgeable people here can help me with this
i have a 245i with labor certification pending since april 2001 . i have for the past two years being doing freelance work . without an ssn or itin i've not been able to pay taxes.
i was thinking of filing form w7 to apply for a itin but the form requires that i demonstrate the basis for income...
since i don't wish to be on the wrong side of irs at the i-485 stage what would you advise i do? do i wait and resolve it all then or should i try filing now
