  • MARRIAGE PETITION

    Hello
My parents filed an asylum application when I was a minor back in 1993. My mom had a brother who had separately petitioned us many years ago. Since our priority date arrived, my parents became eligble for adj of status.I turned 21 during that time and was unfortunately kicked out of the application. I never really pursued my aslyum after that. I did write letters enquiring about my asylum status and stated that I would like to reopen it but I never did.
Icontinued working on my expired work permits since my work never checked. In Aug 2003, I got married to my long time girlfriend who is a US citizen. We did all the paperwork and I had my interview just 2days ago. Its over there that things took an awkward turn. My parents were granted the green card even after the fact that the asylum app was fraudulent and the officer who interviewed them acknowledged that too. I disclosed this fact to my interviewing officer and she immediately put my file into further review. SHe did say that was fraud. I have an I-94 and also have no criminal background.I enetered the country legally as a visitor. My attorney explained to me that since the EAD was an immigration benefit and was attained thru a fraud asylum application, the case could afect me. Am I really at fault here? Do u think my marriage petition will go thru? Please anyone share your views and similar circumstances..Appreciate it...Now I have to wait for a month and evreyday is painful just waiting and anticipating..
    THANK YOU ALL
