    dear friends, i m in deep deep trouble and i need immediate assistance, i will be thankfull to u if u help me, my iri just arrived and i have interview at the embassy in 2 weeks my problem is that i got to us in 96 nad got voilate the b/1 b/2 visa and got voluterly departure but did not leave and got married with us citizen and file the papers but make a long story short could not get the adj of status and gotta go bACK TO COURT AND JUDGE REINSTATE MY vd SO AFTER 2 1/2 YEARS IN MY COUNTRY I RECIVED MY FILE AND MY INTERVIEW is schedlue in 2 weeks, now i m worried if they deny my visa about the basis of my previous voilation and they ask for waiver,but i already spent 2 1/2 years waiting for those papers to be process is there a chance that they deny it and let me wait again

      If you are not in the USA, and you have never filed the I-601, then yes, I am afraid that there is very very very good chance that they will deny your application pending the approval of a waiver.

      If I were you I would start working on the waiver.

        spouse thank u for reply,i was told by many friends thati had enough, the judge told me that i can get my GC from my home country and i have court papers with me, when i came to us in aug 1996 and they let me leave on 14th dec 1996 and i have valid i-94 but i did not and also the judge reinstate my VD request in 2001 and i did departand i got denied my i-130 and it got reapproved (VSC) and process all the papers through the tough nvc procedure and finally got the interview letter and now the fear in my heart, plz look over friends and give me the best. and how long it take the waiver(if i have too) for a spouse of USC thank u again

          Well, it really depends on the country. The best thing to do is to ask the consulate how long it takes to file the I-601.

          The consulate that I filed mine at quoted 1 - 1.5 years, but approved it in slightly less than a year (from submission time). Recently some people have been quoting times of just a couple months (3-6 weeks or something like that) - I don't know how accurate that is, but it would be awesome.

          However, if I were you, I would count on at least one more year from the time of submission. Therefore, if you think that you might be required to submit the I-601 you might want to start working on it asap... as you should be able to submit it very quickly after your interview (if it is required).

          The quicker it is submitted the quicker you will get a response.

          But you will definitely want to put effort into it, as you don't want to spend any more time than necessary away from your spouse.

            I was wonder, do you know if a I-601 can be filed in the states while your sponse is in the states as a visitor?

            I'm a US citizen and am trying to get all the info I can. Thx
